Family Birthday Specific Material Terms

  1. How to Enter or Participate

    During the month of your birth, listen most weekday afternoons for the Family Birthday Contest. If so, when prompted on-air, call the Z-studio lines to attempt to be the tenth caller. The Z-studio lines are 407-682-8888 or *883, a free call from a Cingular Wireless Cell Phone.

  2. Eligibility Restrictions

    You must be a Florida resident to enter. Contestant must have access to a working telephone to participate. In order to win, your birthday must be the birthday in the current month (You can dial for another family or household member- such as a parent for a child. However, that member MUST be near-by and MUST be able to speak on the phone to the producer or host within 60 seconds of receiving the call.)

  3. Entry Deadline Dates

    The game will continue on Z88.3 until further notice with the contest airing on most weekday afternoons. The air portion of the contest ends when we have received the specific phone caller number that was announced.

  4. Whether prizes can be Won

    Prizes are available to only the correct and qualified caller and only when the contest is being played.

  5. When Prizes can be Won

    When a random on-air announcement is made requesting a person celebrating a birthday in the current month to call the Z-studio lines, the air personality or producer will take caller number 10.

  6. The Extent, Nature, and Value of the Prizes

    The prize awarded is announced at the time of the contest. Value is no less than $10.00, but no more than $500.00.

  7. The Basis for Valuation of the Prizes

    Retail value of prize awarded.

  8. Time and Means of Selection of Winners

    The winner is the qualified tenth caller. Calls will be taken in the order in which they are received. When prompted on-air, call the Z-studio lines to attempt to be the tenth caller when the contest is being played. If that caller does not qualify, i.e., does not have a birthday in the current month, then the next caller will have a chance to qualify. The determination of qualification will be made by the producer or show host and is final.

  9. Tie-Breaking Procedures

    Only one prize will be awarded and/or one person is chosen. If more than one person is on the phone line with a birthday in the correct month, only one will be chosen to win and/or will share the prize, i.e., in the case of twins. This determination will be made by the producer or show host and is final.

  10. Additional Conditions / Restrictions

    Z88.3, prize donors and sponsors are not responsible for technical, hardware, software or telephone or other transmission failures of any kind; lost or unavailable network connections; or incomplete, garbled or delayed computer transmissions whether caused by Z88.3, users, by any equipment or programming utilized in promotions, games or contests, or by human error which may occur in the processing of submissions, which may limit a participant’s ability to participate. All contest entries will become the property of Z88.3. Winners and contest participants grants Z88.3 the right to use their name and likeness (including voice) for promotional purposes with no compensation. Z88.3 reserves the right to alter these material terms at any time for any reason.

Compliance Statement

The above contest and the posting of material terms is Z88.3’s goodfaith effort to comply with the statutory provision regarding contests as set forth at Section 508 of the Communications Act of 1934, as amended (the “Act”) (47 U.S.C. §509).  Section 508(a) of the Act (47 U.S.C. §509(a)) and with the Commission’s (FCC) requirements governing the broadcast of licensee-conducted contests set forth in Section 73.1216 of the Commission’s rules, (47 C.F.R. §73.1216).  This rule requires that a licensee that broadcasts or advertises information about a contest that it conducts shall fully and accurately disclose the material terms of the contest, and shall conduct the contest substantially as announced or advertised.  No contest description shall be false, misleading or deceptive with respect to any material term.

For purposes of Section 73.1216, the term “contest” is defined as a scheme in which a prize is offered or awarded, based upon chance, diligence, knowledge or skill, to members of the public.  “Material terms” include those factors which define the operation of the contest and which affect participation therein.  Although the material terms may vary widely depending upon the exact nature of the contest, they will generally include:  (1) how to enter or participate;  (2) eligibility restrictions;  (3) entry deadline dates;  (4) whether prizes can be won;  (5) when prizes can be won;  (6) the extent, nature, and value of the prizes;  (7) the basis for valuation of prizes;  (8) time and means of selection of winners;  and/or (9) tie-breaking procedures.
