Bumper Sticker Thank You for NOJ Tickets: Specific Material Terms

  1. How to Enter or Participate

    A Z88.3 bumper sticker must be placed on the back of a licensed motor vehicle.

    A Z88.3 bumper sticker can be obtained at our studios located at 1065 Rainer Drive in Altamonte Springs, Florida, during regular business hours, at regular Z Van Stops and events or by emailing the station through the bumper sticker request form. NO PURCHASE NECESSARY.

  2. Eligibility Restrictions

    You must be a Florida resident and 18 years of age or older to enter. The Z88.3 bumper sticker must be attached to the back (rear window, rear bumpers, tailgate, etc.) of the vehicle by the sticker’s own adhesive backing to a licensed motor vehicle as to be viewable from behind. Stickers can not be taped inside the glass of the rear window or otherwise attached in a manner to as to be partially or fully obscured from a spotter. Z license plates mounted on the front of a vehicle do not count. Z listeners can also be spotted at any Z88.3 Van Stop.

  3. Entry Deadline Dates

    The contest is scheduled to begin on Monday, August 10, 2009 and is scheduled to end on Friday, September 11, 2009. It is scheduled to run approximately two times a day most weekdays between the hours of 6 a.m. and 10:00 p.m. The air portion of the contest ends after the expiration of 8 minutes and 83 seconds (which calculates to 9 minutes and 23 seconds) from the first on-air announcement of the chosen vehicle descriptions (make, model and/or style) or with the first caller with a bumper sticker on their vehicle which matches the vehicle description announced. If no match is found within the time limit, no prize will be awarded.

  4. Whether prizes can be Won

    Yes, but only if a match is qualified within the time limit.

  5. When Prizes can be Won

    Vehicle descriptions (make, model and/or style) are scheduled to be called out two times a day most weekdays at random times between the hours of 6 a.m. and 10:00 p.m. When the on-air announcer has announced the vehicle description (make, model and/or style), the on-air announcer, producer or intern will take calls. The first person with a bumper sticker on their vehicle which matches the vehicle description announced will be named the winner.

  6. The Extent, Nature, and Value of the Prizes

    Two prizes are scheduled to be to be awarded each weekday during the length of the contest. Each winner will receive one family four pack of tickets to one night of Disney’s Night of Joy. ALL tickets are pre-selected by Z88.3 for either Friday, September 11, 2009, or Saturday, September 12, 2009—there is no negotiation for which night.

    The prize value of each family four pack of tickets is approximately $199.80 plus tax. Prizes cannot be exchanged for any other prize. Prizes must be picked up at the Z88.3 office during normal business hours (Monday-Friday 8a.m.-5 p.m.) at 1065 Rainer Drive in Altamonte Springs, Florida.

    All prizes must be picked up by 5 p.m. on Wednesday, September 9, 2009 or the prize will be forfeited.

  7. The Basis for Valuation of the Prizes

    Retail value of prize awarded.

  8. Time and Means of Selection of Winners

    The air portion of the contest begins when a vehicle description (make, model and/or style) are picked from the database and broadcast. This is scheduled to occur two times a day most weekdays between the hours of 6 a.m. and 10:00 p.m. Within a time limit of 8 minutes and 83 seconds (which calculates to 9 minutes and 23 seconds) the first caller through to the studio line, 407.682.8888 with a bumper sticker on their vehicle which matches the vehicle description announced wins the prize. If no match is found within the time limit, no prize will be awarded.

  9. Tie-Breaking Procedures

    In the event that the caller fails to give complete and accurate information or the connection is lost (see below) before the call is terminated, the next complete and accurate caller will be chosen as the winner. Only one (1) winner per household will be allowed per 30 day period. In the event that a previous winner or household member of a winner is selected, their prize will be forfeited. Any other tie breaking procedures are at the discretion of Z88.3 Management.

Additional Conditions/Restrictions

Z88.3, prize donors and sponsors are not responsible for technical, hardware, software or telephone or other transmission failures of any kind; lost or unavailable phone connections; or incomplete, garbled or delayed transmissions whether caused by Z88.3, users, by any equipment or programming utilized in this contest, or by human error. Each winner will be instructed to pick up their prize with valid photo identification at the Z88.3 Office in Altamonte Springs, Florida. All scheduled dates and times are approximate and subject to change. Prizes are not transferable. Winner is responsible for all taxes, fees and parking associated with this prize. Winners and contest participants grants Z88.3 the right to use their name and likeness (including voice) for promotional purposes with no compensation. Z88.3 reserves the right to alter these material terms at any time for any reason.

Compliance Statement

The above contest and the posting of material terms is Z88.3’s goodfaith effort to comply with the statutory provision regarding contests as set forth at Section 508 of the Communications Act of 1934, as amended (the “Act”) (47 U.S.C. §509).  Section 508(a) of the Act (47 U.S.C. §509(a)) and with the Commission’s (FCC) requirements governing the broadcast of licensee-conducted contests set forth in Section 73.1216 of the Commission’s rules, (47 C.F.R. §73.1216).  This rule requires that a licensee that broadcasts or advertises information about a contest that it conducts shall fully and accurately disclose the material terms of the contest, and shall conduct the contest substantially as announced or advertised.  No contest description shall be false, misleading or deceptive with respect to any material term.

For purposes of Section 73.1216, the term “contest” is defined as a scheme in which a prize is offered or awarded, based upon chance, diligence, knowledge or skill, to members of the public.  “Material terms” include those factors which define the operation of the contest and which affect participation therein.  Although the material terms may vary widely depending upon the exact nature of the contest, they will generally include:  (1) how to enter or participate;  (2) eligibility restrictions;  (3) entry deadline dates;  (4) whether prizes can be won;  (5) when prizes can be won;  (6) the extent, nature, and value of the prizes;  (7) the basis for valuation of prizes;  (8) time and means of selection of winners;  and/or (9) tie-breaking procedures.
